Open-access Importance of Military Justice in the past, present and future of the Dominican Republic

Abstract:

The organization and subsequent division of society into classes, brought with it different jurisdictions to somehow access justice, instituting different courts, emerging the military for soldiers. It should be noted that Justice in general, including the military is an almost perfect system that seeks to prevent the commission of acts against the rules, punishes and removes from society those who commit it, however, the actors in the system that are in one way or another influence at some point the established rules, either for their convenience or for a third party, which leads to a certain injustice. Although there are opinions against the Military Jurisdiction, it must be considered that through the years, it has fulfilled its mission of keeping the discipline, tradition and institutional order of the military organizations, which is why it also has its defenders. Finally, the Military Courts continue to be instituted and to hear the infractions classified as Military Crimes. It should also be noted that modern States need Armed Forces prepared at all levels and motivated, with their tasks and doctrine protected juridically, both to defend themselves of conventional and unconventional threats from abroad, as to guarantee peace and security in the internal order.
