Open-access Crimes against National Security and Defense in the Spanish legal system

    Abstract

    Thisbring forward is a brief exposition of the Spanish criminal law to protect and guarantee national security and defense. Based on its double punitive treatment, it will be determined which cases should be heard by the ordinary jurisdiction and which by the military jurisdiction. Likewise, a fleeting reference will be made to curious particular that has occurred in relation to these criminal cases since the new Spanish judicial organization established by the 1978 Constitution came into force.
